Is it lawful to charge prospect employees a fee for background check

I have just open a business where I send attendant to peoples home to either clean, run errands, grocery shop....The thing is to assure my customers security and the security of my company before hiring I charge the prospect employees a small fee to check their background. I would like to know if this is lawful..--Answer1:Ive got to tell you, Ive NEVER heard of that. Its always been on the companys dollar for me..--Answer2:It is supposed to be out of the employers own pocket to do these things. You are likely scarring away many good potential employees with this tactic. Interview the employees first and then give background checks to only the ones you plan on hiring, ie. the ones with the most potential.I know if an employer told me that they were going to charge me for a background check for a job I only have a possibility of obtaining, well I would walk out right there.
