Did design work without contract- am I screwed

A guy saw my portfolio online and emailed asking me to make designs for t-shirts. As for payment his email said "At this point we are paying forty an hour rate for art time with the one designer. If you would like to submit some designs and we like them we would be more then welcome to pay you for your time".Usually, I operate via email- but under a contract. I told him Id make three samples, send them as jpgs, and if he liked them, Id send an invoice. When I receive payment, Ill email the final pdf. I thought this would be a quick buck- so I went ahead w/ the "verbal" agreement. I sent him 2 designs which he really liked but wanted a few revisions/updates, I sent him the jpg with the designs revised and completed but havent heard back in a week (even after I sent a "hey remember me" email). Am I doomed to never receive any payment? How should I handle this?.--Answer1:Either he pays you or he doesnt.If he doesnt, you can try to sue him..--Answer2:Nope -- the correspondence makes everything clear. Send the invoice..--Answer3:Moving forward, I would only send jpgs with a watermark so your design cannot be stolen. Im not sure if you do this already.At this point, I would deliver an invoice for your time and final design.Unfortunately people always want something for nothing. There are people out there who will try to swindle you anyway they can... just protect yourself from here on out with a contract..--Answer4:An email correspondence is typically enough evidence to sue someone. Send him the bill with a due date and if he doesnt pay, file a case in small claims court. Of course youll want to take print outs of all of your email conversations. Also, you legally own the copyrights on your own work until you sell it. If he is using your work and cannot prove that he paid for it, then you have another grounds for a lawsuit. This one would be big enough that you wouldnt file it in small claims court..--Answer5:From now on, watermark your proofs and drafts.
