Answer1:You should be careful - The existing shop is an already established business - and could take you to court for impersonating them !Their company name will already be registered with company house.
Answer2:if you name your business the same as someone elses and it is in the same sector, then that business can then object to this and have you change your name. If it is a limited company and they have registered their name, then they will be able to do that easier. however if your name is in the title and so is theres ie...hair by ross and hair by john, then you may not have to change it. it all depends on what the other business wants to do.
Answer3:Its a fairly common name, and seeing as they havent patented it you can still use it.
Answer4:You should have looked into this first...you need to change the name of your business a.s.a.p...as they are established they have the right to the name...
Answer5:Seriously I wouldnt worry about it.Neither of you are likely to be able to claim trademark to it because of its open nature - the word Beauty is not really trademarkable.Anyway Beauty by Mary is a totally different name.You wont have any problem.Rather than worry about that sort of nonsense - get yourself down to the printers and have a few thousand flyers printed off - should cost about £150 - and get them stuck through every door in the area.Get your flyers into the local school as well, and place a small ad in local newspaper.In business its all about bums on seats - just make sure you get more customers than your rival!!!good luck!
